1. Overview & General Return Window

At Smoke & Temple, the fulfillment method depends entirely on the type of item you purchased. Please review our policy carefully below based on whether you ordered an exclusive membership package or standard retail merchandise.

2. Exclusive 1-Run-Only Membership Merchandise

  • Batch-Run Nature: All merchandise tied to our early-bird membership tiers is exclusive, limited 1-run-only items. Because these orders are batched together and custom-produced in a single collective print run to support our initial business build-out and launch, all exclusive membership merchandise sales are final.

  • Returns & Exchanges: We cannot accept returns, size exchanges, or cancellations for exclusive membership merchandise once the order is placed.

3. Standard On-Demand Retail Merchandise

  • Fulfillment: Standard retail merchandise purchased outside of exclusive membership campaigns (such as general catalog items) is custom-printed and fulfilled on-demand through third-party printing partners.

  • Returns & Exchanges: Unworn, unwashed apparel and undamaged standard retail merchandise may be exchanged or returned for store credit within 30 days of delivery, provided you present a valid order confirmation. Note: Customers are responsible for return shipping costs on standard exchanges unless the item arrived damaged.

4. Damaged, Defective, or Misprinted Items

We stand by the quality of our gear. If your item arrives damaged, structurally defective, or misprinted:

  • You must notify our support team within 7 days of delivery.

  • You must provide photographic proof of the defect or damage.

  • Once verified, we will coordinate a free replacement for you (shipped via our batch-run or print partner depending on the item type).

5. Incorrect Shipping Addresses

Customers are solely responsible for entering a complete and accurate shipping address at checkout. If a package is returned to us due to an incorrect address entered by the customer, reshipment fees will apply.

Smoke & Temple — Early-Bird Membership & Merchandise Terms & Conditions

1. Overview, Fund Allocation & General Nature of Purchase

  • Early-Bird Window: This phase stops at capacity, or exactly one (1) month prior to the official Grand Opening date to allow for merchandise shipping fulfillment, after which memberships defer to single-use membership pricing.

  • Strictly No Online Food or Alcohol Sales: You explicitly acknowledge and agree that no alcohol or food is being sold online. Online transactions are exclusively for purchasing physical merchandise items, unlocking VIP-level access to future discounts and perks post-launch, and supporting the initial setup of the business.

  • Explicit Fund Allocation: You expressly acknowledge and agree that all funds collected from early-bird membership sales are allocated directly toward business build-out costs, physical space renovations, brewing and kitchen equipment acquisition, initial inventory, and opening capital for Smoke & Temple.

  • Age Verification (21+): All sales from Smoke & Temple are strictly age-verified for individuals 21 years of age or older at all stages of the sales process, including online checkout. By completing a purchase, you certify under penalty of law that you are at least 21 years of age.

  • Nature of Goods & Perks: You are NOT purchasing food or drink credits, vouchers, equity, or future points of any kind.

  • What You Receive & Timeline: Your purchase grants you one physical custom limited-release item (either one custom T-shirt or one custom Pint Glass per order), plus access to VIP-level discounts for a one-time-only 24-month period. The 24-month membership period begins strictly on Grand Opening Day and not a moment sooner. Extras may be purchased separately.

  • No Cash Value & Final Sale: Early-bird memberships hold no cash value, cannot be redeemed for cash, and are final sale with zero refunds once purchased.

  • Information Collection: Necessary member and age-verification information will be collected at checkout.

2. Unlocked Perks Upon Grand Opening

Every tier unlocks the following benefits upon the Grand Opening:

  • Base Discount: A 12% discount locked in for a 24-month membership period (commencing on Grand Opening Day).

  • Enhanced Brew Pours: All members on a designated brew/beer tier receive 20oz pours for all beer selections at standard 16oz pricing, stacked on top of their membership discount.

  • Exclusive Email Coupons: Exclusive email coupons on merchandise and new releases, featuring higher value discount thresholds reserved exclusively for VIP early-bird members compared to standard public memberships.

  • Pre-Grand Opening VIP Party: Exclusive, invitation-only access to a private Pre-Grand Opening VIP Launch Event held prior to the public opening date for early-bird tier members and their permitted guests.

  • Private Tastings & Specials: Exclusive invitations to private tastings of newly released brews and culinary food specials, tailored directly to the specific scope and focus of each member's tier.

3. Membership Tiers & Pricing Structure

  • 100x Beer for 1: $100 (Includes 20oz pours for 16oz prices)

  • 75x Deli (Lunch) for 1: $100

  • 75x Pizza (Dinner) for 1: $125

  • 50x Lunch for 2: $180

  • 50x Dinner for 2: $230

  • 50x Lunch+beer for 2: $375 (Includes 20oz pours for 16oz prices)

  • 50x Dinner+beer for 2: $425 (Includes 20oz pours for 16oz prices)

  • 50x Family Dinner for 4: $475 (Includes +1st Pitcher at 20% off for standard in-house visits)

  • 20x Catering - Group of 6 (Deli platters and pizza only): $650 (Includes +1 private catered party per year (2) at 18% off the whole party ticket with drinks included for up to 6 people, plus +1st Pitcher at 20% off for standard in-house visits)

  • 15x Office of 10 (Deli platters and pizza only): $1,400 (Includes custom glassware/coaster advertising in house (x20), +1st Pitcher at 20% off for standard in-house visits, plus +1 private catered party per year (2) at 18% off the whole party ticket with drinks included for up to 10 people)

4. Operational Rules, Redemption Guidelines & In-House Limitations

  • Menu Definitions: Lunch and dinner run all day; the lunch menu features the deli, and the dinner menu features the pit house (pizza/BBQ).

  • In-House Tickets Only (Strictly No To-Go, Cans, or Growlers): Every membership discount applies strictly to in-house tickets only. Discounts do NOT apply to any to-go items, packaged cans, bottle sales, growler fills, retail merchandise products, or general outside takeout.

  • Catering Exclusions: Standard food and beer membership discounts do not apply to catering packages or private catered party bookings, which are governed solely by their specific tier terms (deli platters and pizza only where specified). Furthermore, the 20% off 1st Pitcher perk applies exclusively to regular standard in-house visits and is not valid during the 1-per-year private catered parties.

  • In-Person Redemption & Age Check: All onsite transactions and perk redemptions must be made in person by the membership holder, accompanied by a valid, matching government-issued photo I.D. proving 21+ status.

  • Non-Stacking & Multi-Membership Abuse Prevention: Discounts do not stack on one item or for any person of a group holding multiple memberships. Furthermore, purchasing multiple identical memberships to artificially inflate, exploit, or manipulate discount structures beyond stated tier limits is strictly prohibited. Management reserves the right to void duplicate exploits without refund. For example, you cannot combine a lunch+beer for 2 and a solo beer to claim 24% off your beer.

  • Combining Different Clubs: You can hold and combine a non-beer club with a beer club ticket (e.g., lunch for 2 combined with a solo beer club, or pizza for 4 combined with 2 solo beer clubs). Food and beer are discounted distinctly.

5. Merchandise Fulfillment Structure (Exclusive Batch vs. On-Demand)

  • Exclusive 1-Run-Only Membership Merch: All early-bird membership merchandise items are exclusive, limited 1-run-only items. These items require gathering the total pool of orders before initiating a single collective production run. Consequently, they are subject to batch production timelines and will ship out together ahead of the Grand Opening.

  • Standard Retail Merchandise (Post-Opening / General Catalog): Standard retail merchandise purchased outside of exclusive membership drops (such as general catalog items added post-opening or ongoing online merchandise) is printed and shipped on-demand through third-party fulfillment partners, subject to standard print-on-demand production windows.

  • Pricing & Availability: All retail merchandise prices are listed in US Dollars and are subject to change without notice. Orders are subject to product availability; Smoke & Temple reserves the right to limit quantities or cancel orders for out-of-stock items with a full refund for the affected item.

  • Returns & Exchanges:

  • Post-Opening Retail Purchases: Unworn, unwashed apparel and undamaged standard post-opening merchandise may be exchanged or returned for store credit within 30 days of purchase or delivery, provided the customer presents a valid receipt or order confirmation.

  • Exclusive 1-Run Membership Items: Due to their bespoke, crowd-support, and single-run nature, exclusive membership items are non-returnable and non-refundable unless damaged or defective upon arrival.

  • Defective Items: If you receive a damaged or defective item (exclusive run or on-demand retail), you must notify Smoke & Temple customer support within 7 days of delivery with photographic proof to receive a free replacement.

6. Grand Opening Timeline, Shifts & Fluid Scheduling

  • Dynamic Opening Timeline: The official Grand Opening date for Smoke & Temple is an estimated target subject to change based on construction milestones, equipment installations, final inspections, and municipal permitting processes.

  • Timeline Adjustments & Notices: Management reserves the right to adjust, shift, or extend the target opening timeline as necessary to ensure full regulatory compliance and operational readiness.

  • Impact on Pre-Orders and Membership Validity: Because the opening timeline is fluid, the one (1) month pre-order merchandise closing window and the commencement of the 24-month membership period will automatically recalibrate to align with the newly established official Grand Opening date. Notice of any official timeline updates will be communicated to members via email and posted on official channels.

7. Membership Policies, Safeguards & Legal Disclaimers

  • Strictly Non-Transferable: Memberships belong solely to the individual registered at checkout. They are non-transferable, cannot be resold, and cannot be shared.

  • Code of Conduct & Right to Refuse Service: Management reserves the right to refuse service, cut off alcohol service, or suspend/revoke memberships without refund for disorderly conduct, harassment of staff or patrons, violation of safety or liquor laws, or attempts at fraudulent discount stacking/unauthorized identity use.

  • Business Continuity & Default: Because early-bird funds are directly allocated toward startup, build-out, equipment, and inventory, memberships remain non-refundable. In the unlikely event of permanent business closure or structural interruption prior to the fulfillment of the 24-month period, memberships cannot be refunded.

  • Health & Allergen Disclaimer: Smoke & Temple prepares house-smoked meats, pizzas, and foods that may contain or come into contact with common allergens (nuts, dairy, gluten, soy, etc.). Patrons consume food and beverage products at their own risk.

  • Alcohol Consumption & Liability: Patrons agree to consume alcoholic beverages responsibly. Smoke & Temple and its management assume no liability for incidents arising from over-consumption or failure to comply with local laws.

  • Modifications to Terms: Management reserves the right to update or modify these terms and conditions as the business scales, with notice provided via email or posted on-site.

  • Force Majeure: Smoke & Temple is not liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms caused by events outside our reasonable control, including but not limited to natural disasters, supply chain failures, public health emergencies, government actions, or construction/permitting delays impacting the grand opening timeline.

8. Merchandise Shipping & Fulfillment Policy

  • Exclusive Run Closing & Fulfillment Window: All orders for the exclusive 1-run-only membership merch will officially close exactly one (1) month prior to the finalized Grand Opening date. Once the window closes and the single collective print run is executed, fulfillment and direct carrier shipping will ensure that every member receives their exclusive gear ahead of or right in time for Grand Opening Day.

  • On-Demand Fulfillment Windows: Standard post-opening retail merchandise orders placed online are processed and printed on-demand through our print partners, typically shipping within standard carrier delivery schedules.

  • Shipping Address Accuracy: Members and customers are solely responsible for providing an accurate, deliverable shipping address at checkout. Smoke & Temple is not responsible for items shipped to incorrectly entered addresses. Replacement shipments for user-error address mistakes may incur additional shipping fees.

9. High-Ticket Processing & Stripe Chargeback Protections

  • Acknowledgment of High-Value Transactions: Members purchasing higher-tier packages (including Catering and Office tiers up to $1,400) explicitly acknowledge that these transactions involve bundled promotional rights, advertising, pre-opening event access, private tastings, and future event privileges alongside physical merchandise and capital crowd-support.

  • Final Sale & Chargeback Waiver: Due to the limited-release, bespoke nature of Smoke & Temple memberships, all high-ticket and standard tier sales are strictly final and non-refundable.

  • Dispute & Chargeback Agreement: By completing an online transaction via Stripe, the cardholder agrees that they are purchasing custom merchandise and future-dated VIP access rights while contributing to foundational business capital. The cardholder explicitly waives any right to initiate a chargeback with their financial institution based on grand opening timeline shifts, failure to use membership perks, or buyer's remorse, recognizing that unauthorized chargebacks constitute a breach of contract and financial fraud.

  • Governing Law & Venue: This agreement is governed by and construed in accordance with the laws of the State of Washington. Any legal action or proceeding arising out of or relating to these terms shall be brought exclusively in the courts located within Washington state.
